Satellite positioning equipment rental and mountaineering stay-at-home service contract
Article 1 Service Content <br>Party A (Mabugu Outdoor Co., Ltd.) agrees to provide Party B with a mountaineering stay-at-home service. It will retain and track Party B’s trajectory data during mountaineering activities through Garmin inReach satellite positioning equipment to ensure Party B’s safety. and activity records.
Article 2 Rights and Obligations of Party A
- Party A shall provide stable, reliable and technically proven Garmin inReach equipment and be responsible for the maintenance and update of the equipment.
- Party A is responsible for monitoring Party B’s trajectory data during mountaineering activities to ensure the security and integrity of the data.
- When Party B encounters abnormal trajectory during mountaineering activities, Party A shall immediately notify the emergency contact person provided by Party B and assist in handling emergencies.
Article 3 Rights and Obligations of Party B
- Party B should be familiar with and follow the Garmin inReach equipment usage instructions provided by Party A to ensure the correct operation of the equipment and avoid damage.
- Party B must ensure that the equipment has sufficient power during the event to avoid equipment failure due to insufficient power.
- Party B must return the equipment according to the agreed time after the event and keep the equipment in good condition.
Article 4 Personal Information Collection and Authorization
- Party B agrees that Party A collects, uses, preserves and processes its mountaineering trajectory information in accordance with the "Personal Data Protection Law" and is limited to the purposes related to mountaineering left-behind services.
- Party B guarantees that the personal information provided is true and complete, and assumes liability arising from providing false information.
- Party A promises that Party A will not provide Party B's trajectory information to any third party unless required by law or Party B agrees in writing.
- Before providing emergency contact information, Party B must first obtain the consent of the contact person and inform him of the relevant rights and obligations.
- When an emergency occurs, Party B authorizes Party A to provide its positioning information to emergency contacts, rescue units or relevant law enforcement agencies to ensure Party B's safety.
- Party A may use Party B's information for statistics or analysis for non-specific purposes after de-identification.
- According to the "Personal Data Protection Law", Party B is aware of the following rights:
- Collection purpose : Provide mountaineering stay-at-home services and emergency rescue.
- Data retention period : from the effective date of the contract to the end of the service.
- Data use objects : Party A, Party B’s emergency contact persons, rescue units and relevant law enforcement agencies (limited to emergencies).
- Data usage area : limited to Taiwan.
- Data storage method : including electronic and non-electronic storage forms.
- Party B's rights : In accordance with the "Personal Data Protection Law", Party B has the right to inquire, correct, stop collecting or request deletion of its personal data.
Article 5 Disclaimer <br>Party B understands and agrees that Party A is not responsible for any service interruption or loss caused by the following circumstances:
- Garmin inReach equipment malfunctions, is damaged, or loses communication during mountaineering activities.
- Due to bad weather or force majeure factors (such as typhoons, heavy rains, etc.), service quality may be affected or positioning may be impossible.
- Since mountaineering activities are inherently risky, the services provided by Party A are limited to stay-at-home assistance, and Party A is not responsible for any accidents or losses during the mountaineering process.
Article 6 Security Deposit
- Party B shall pay a deposit of NT$12,000 when signing this contract.
- After Party B returns the undamaged Garmin inReach equipment as agreed, Party A will refund the deposit without interest.
- If Party B returns the equipment overdue, Party A can deduct a daily return fee of NT$150 from the deposit.
- If Party B causes damage or loss to the equipment, Party A has the right to deduct the corresponding compensation costs from the security deposit.
Article 7 Other Terms
- This contract takes effect from the date it is signed by both parties and will be valid until the day Party B completes the mountaineering activities and returns the equipment.
- If a dispute occurs, both parties shall resolve it through negotiation in good faith. If negotiation fails, both parties agree that the court where Party A is located shall be the jurisdictional court.
- If any provision of this contract is deemed invalid by a court, the invalidity will not affect the validity of other provisions.
- If there are any matters not covered in this contract, they will be handled in accordance with the relevant laws of the Republic of China.
